Welcome to Daily Sushi – ITPL (the CAVS Food Pvt. Ltd. Under Franchise agreement with BUZA Foods Pvt. Ltd.). These Terms & Conditions (the “Terms”) govern your access to and use of dailysushi-itpl.in (the “Site”) and any services we provide via the Site, phone, WhatsApp, or authorised delivery partners (collectively, the “Services”). By visiting or using any part of the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Definitions

  • User / You Any natural or legal person who accesses or uses the Services.
  • Order / Reservation A request for food, beverages, or a table, placed via phone, WhatsApp, in person, or through authorised third-party platforms.
  • Content All text, graphics, photos, audio, video, code, reviews, and other materials displayed on or downloadable from the Site.
  • Third-Party Platforms External services we integrate with or link to (e.g., Google Maps, Zomato, Swiggy, WhatsApp, Facebook).
  • BUZA Foods Pvt Ltd The franchisor and registered owner of the “Daily Sushi®” brand. We operate under a valid franchise agreement.

Eligibility & Acceptance

  • 1. You affirm that you are at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering binding contracts.
  • 2. Users aged 13–17 may use the Services only under a parent or guardian’s supervision and with their consent.
  • 3. By accessing or using the Services, you acknowledge that you have read, understood, and agreed to these Terms as well as our Privacy Policy (incorporated by reference).

Service Scope

Dining & Reservations

  • Reservations are accepted via phone or WhatsApp and are confirmed only upon our explicit acceptance.
  • We reserve the right to modify or cancel reservations (e.g., capacity limits, safety regulations, force-majeure events).

Delivery Orders

  • When you order via a platform, you enter a direct contract with that platform under its terms; our obligations are limited to food preparation and hand-off.

Menu, Pricing & Availability

  • Menu items, descriptions, and prices on the Site are for informational purposes only and may change without notice.
  • Taxes and statutory charges apply as per law.
  • If an advertised item is unavailable, we may offer an alternative or cancel the item.

Alcohol Service

  • Alcoholic beverages (if any) are served only on-premise and strictly to patrons of legal drinking age under applicable laws. Alcohol is not sold or delivered online.

Promotions & Vouchers

  • Coupons, discounts, or promotional offers are valid only per their stated terms (expiry, minimum order value, etc.).
  • We may amend or withdraw promotions at our sole discretion.

Allergy & Dietary Notice

  • Our kitchen handles common allergens (soy, sesame, nuts, shellfish, gluten, etc.). Despite best efforts, we cannot guarantee the absence of trace allergens. Guests with allergies must notify staff before ordering.

User Obligations & Acceptable Use

You agree not to:

  • 1. Violate any applicable law, regulation, or third-party right while using the Services.
  • 2. Post, transmit, or upload unlawful, defamatory, harassing, hateful, obscene, or misleading Content.
  • 3. Misrepresent your identity or falsely imply affiliation with us, our franchisor, or any other entity.
  • 4. Interfere with or disrupt the Site (e.g., hacking, malware, data-mining beyond robots.txt allowances).
  • 5. Attempt unauthorised access to our systems or data, or harvest personal information of others.
  • 6. Use the Services for competitive analysis, automated bulk scraping, or to build a competing product.

Violation may result in suspension or termination of access and, where appropriate, legal action.

Intellectual Property

Ownership: All Content is owned by [CAVS Foods Private Limited] or licensed from BUZA Foods Pvt Ltd, affiliates, or licensors, and is protected by Indian and international IP laws.

Trademarks: Daily Sushi® and related marks are registered trademarks of BUZA Foods Pvt Ltd and used under licence. All third-party marks remain property of their respective owners.

Limited Licence: We grant you a personal, non-exclusive, non-transferable, revocable licence to access the Site for non-commercial use, conditioned on compliance with these Terms.

User Content

  • If you submit reviews, photos, or other materials (“User Content”) you grant us a worldwide, perpetual, royalty-free licence to use, reproduce, display, adapt, and distribute such Content in connection with the Services and marketing (including Google Ads).
  • You warrant that your User Content is accurate, non-misleading, and does not infringe third-party rights. We may moderate, edit, or remove User Content at our discretion to comply with Google Ads & Search policies.

Infringement Notices: If you believe any Content infringes your IP rights, please send a notice to legal@dailysushi-itpl.in with supporting evidence. We will investigate and take appropriate action, which may include removing the Content or disabling access.

Reviews & Testimonials

External Reviews: The Site may display ratings sourced from Google, Zomato, Swiggy, or other external review platforms. We do not alter these external reviews but may curate excerpts for display.

Manual Testimonials: We also collect written or verbal feedback in-restaurant (e.g., comment cards) and upload selected testimonials to the Site.

  • Customers are informed and may decline inclusion.
  • We may use initials, first names, or anonymised identifiers to protect privacy.
  • Testimonials are reproduced verbatim except for minor grammatical edits; we do not fabricate or incentivise reviews.

Prohibited Conduct: Submitting false, defamatory, or paid reviews without disclosure violates these Terms and Google Misrepresentation policy. We reserve the right to remove any suspicious feedback.

Privacy & Cookies

Your privacy is governed by our Privacy Policy (see /privacy). The Policy explains our use of cookies, Google Analytics, Google Ads remarketing tags, and Facebook Pixel, and outlines your rights under Indian law, GDPR, and CCPA. By using the Services, you consent to those data practices.

Third-Party Links & Integrations

The Site contains links to and integrations with Third-Party Platforms (e.g., Google Maps, Zomato, Swiggy, WhatsApp, Facebook). We do not control and are not responsible for the content, privacy, or security of those services. Access them at your own risk and review their terms independently.

Disclaimer of Warranties

The Services are provided “as-is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties—express or implied—including merchantability, fitness for a particular purpose, non-infringement, accuracy, and continuous availability. We do not warrant that the Site will be secure, error-free, or uninterrupted.

Limitation of Liability

To the maximum extent permitted by law, we and our directors, officers, employees, licensors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to these Terms or the use of the Services, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed 500 INR or the amount you paid us for the order giving rise to the claim, whichever is greater.

Indemnification

You agree to indemnify and hold harmless [CAVS Foods Private Limited], BUZA Foods Pvt Ltd, and their affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising out of or related to:

  • 1. Your breach of these Terms;
  • 2. Your misuse of the Services;
  • 3. Your User Content;
  • 4. Your violation of any law or third-party right.

Force Majeure

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, pandemics, strikes, labour disputes, war, acts of terrorism, civil disturbances, governmental actions, or interruption of utilities or communications.

Modifications to Services & Terms

We may modify or discontinue any aspect of the Services, or these Terms, at any time. Material changes will be announced via the Site. Continued use after changes constitutes acceptance. If you disagree with any modifications, your sole remedy is to stop using the Services.

Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka. If you are a consumer outside India, mandatory consumer protection laws of your country may still apply.

Severability & Waiver

If any provision of these Terms is held invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force. No waiver by us of any breach or default constitutes a waiver of any subsequent breach or default.

Entire Agreement

These Terms, together with the Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and us regarding the Services and supersede all prior or contemporaneous agreements, communications, or understandings.
